Overview

DAPTs — available in 19 states (best: Nevada 2-yr statute, South Dakota 2-yr, Delaware 4-yr, Alaska 4-yr) — allow you to be both grantor AND discretionary beneficiary of an irrevocable trust that shields assets from future creditors. Once 2-year statute runs, assets are unreachable by lawsuits, divorce (in some states), tax judgments. Requires independent trustee, no fraudulent transfer at funding, no bad-faith intent. Best for pre-liability planning (before doctors get sued, before divorce filed, before business risk materializes).
